Participant Terms and Conditions
The Earth Observing Dashboard (“EO Dashboard”) is a website owned and maintained by the European Space Agency (“ESA”), with data provided from multiple sources including ESA, the Japanese Aerospace Exploration Agency (“JAXA”) and the National Aeronautics and Space Administration (“NASA”). The EO Dashboard Hackathon is an activity being run by NASA with cooperation from ESA and JAXA. The EO Dashboard Hackathon website is run and maintained through a NASA contractor.
BY PARTICIPATING IN THE EARTH OBSERVATION (EO) DASHBOARD HACKATHON YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS:
"Participant" or "you" means an individual who registers for the EO Dashboard Hackathon.
"NASA" or "Agency," as used herein, means the National Aeronautics and Space Administration, and includes its support contractors (at any tier) that are assisting NASA with the planning and execution of the EO Dashboard Hackathon.
PARTICIPATION
Participation in the EO Dashboard Hackathon (or "the event") is fully voluntary, and participants are not entitled to compensation, nor will they be considered employees, agents, independent contractors, or consultants of NASA or of the United States (U.S.) Government. Individuals who participate in the event shall engage in their personal capacity only, including identifying themselves by their own names. If a Participant works for a Federal Government support contractor, that individual shall not reference the fact that they are a Federal Government support contractor, nor shall any work performed for or in support of the event be performed pursuant to or charged under such contract. All Federal Government contractor employee participation shall be done on a voluntary basis outside of the participant’s working hours, and these participants shall not receive or be entitled to any compensation for the time that they spend preparing for or participating in the event. Federal Government civil servant employees are not eligible to register as Participants.
The EO Dashboard Hackathon will be held virtually starting on June 23, 2021. You must be registered to participate in the EO Dashboard Hackathon online at https://eodashboardhackathon.org. Participants who are under the age of 18 are required to be registered for the event by a parent or legal guardian and must be accompanied during the event at all times by a parent or legal guardian. By signing up for an account and/or registering for an event, you permit the EO Dashboard Hackathon organizers to send information about the event and notification messages to your registered email address.
SUBMISSIONS:
All submitted solutions ("Solutions") shall directly address one or more of the EO Dashboard Hackathon challenge statements ("Challenges") as described at https://EODashboardHackathon.org. Solutions that do not address a specific Challenge may be posted publicly on a NASA website at NASA’s sole discretion. By submitting a Solution, you grant NASA permission to display, copy, combine, compile, distribute, and disseminate your Solution to support the EO Dashboard Hackathon. All Solutions will be posted at NASA's sole discretion. Whether or not a publicly posted solution will appear on the EO Dashboard website is in the sole discretion of ESA, and NASA provides no assurance that any solutions will appear on that website. Solutions will not be accepted or posted if they include:
- Threatening, slanderous, or obscene language;
- Personal attacks;
- Discriminatory language (including hate speech) based on race, national origin, age, gender, sexual orientation, religion, or disability;
- Sexually explicit material or other material that violates the law;
- Material that promotes commercial services or products;
- Proprietary or business sensitive information that you do not have the right to make public;
- Solutions submitted for which you do not hold the copyright or other intellectual property rights; or
- Personally Identifiable Information (e.g., birthdays, social security numbers, home addresses, home phone numbers) aside from a name, email address, country of origin and photo as may be appropriate
INTELLECTUAL PROPERTY RIGHTS IN SOLUTIONS:
All Solutions which NASA publicly posts will be available for others to download or use. You agree that any original content (that is, content that you have created for the EO Dashboard Hackathon) is freely available without restriction or is licensed as open source as defined by the Open Source Initiative (OSI): https://www.opensource.org/docs/osd. If you do not specify a specific OSI compliant license, NASA will distribute your original content under an Apache 2.0 license, and by submitting a solution to NASA without a specified license you agree to such distribution. See https://www.opensource.org/licenses/Apache-2.0.
USE OF THIRD-PARTY MATERIALS:
If your Solution requires the use of materials (such as a dataset or code) (your "Solution Materials") that are not provided by NASA ESA, or JAXA, you are responsible for ensuring that your Solution Materials are freely and publicly available without restriction or, at a minimum, are also licensed as open source as defined by the Open Source Initiative: http://www.opensource.org/docs/osd. Examples of appropriate licenses can be found at: http://www.opensource.org/licenses. You are solely responsible for all required verification or investigation of the requisite public availability of your Solution Materials prior to submitting your Solution. You are also solely responsible for ensuring that your Solution and Solution Materials do not contain any export-controlled information pursuant to the International Traffic in Arms Regulations or the Export Administration Regulations. Any licenses applicable to your Solution Materials must be identified in the documentation that you submit with your Solution. NASA will not accept or post any Solutions that do not include appropriate license documentation for your Solution Materials.
WARRANTIES:
You represent and warrant that you have sufficient rights to: (1) authorize the publication and dissemination of your Solution to support the EO Dashboard Hackathon; and (2) use and authorize others to use your Solution Materials, regardless of whether you or someone else owns those materials (as specified in the "Use of Third Party Materials" section of these Participant Terms and Conditions). You are entirely responsible for your Solution. This means that you are responsible if your Solution: (1) is determined by NASA to be defamatory, abusive, derogatory, offensive, or otherwise inappropriate; (2) violates any laws, rules, or regulations; or (3) infringes or constitutes a misappropriation of, any intellectual property rights or confidential information of any third party. NASA, at its sole discretion, reserves the right to remove you at any time as a participant and your Solution from the EO Dashboard Hackathon website for a violation of the EO Dashboard Hackathon rules.
PUBLICITY:
Except where prohibited, submission of a Solution constitutes your consent for NASA to use your name, country information, photo or likeness, and/or information about your Solution for informational purposes in connection with the EO Dashboard Hackathon through any form of media, worldwide, without further permission, payment, or consideration.
LIABILITY:
You agree to release NASA from and hold NASA harmless against any and all claims against the Agency resulting from any breach of any of the representations, warranties or obligations contained in these Participant Terms and Conditions, committed by you or by any other participant, including but not limited to claims related to the use of your Solution Materials. You assume any and all risks to you associated with the submission of your Solution to the EO Dashboard Hackathon and your participation in the event. Therefore, you also waive and release any and all claims or causes of action against NASA, the U.S. Government, and its officers, employees, and agents for any and all injury and damage of any nature whatsoever (whether existing or thereafter arising, whether direct, indirect, or consequential, and whether foreseeable or not), arising from the submission of your Solution to the EO Dashboard Hackathon and for your participation in the event.
